Postpaid Plan Terms and Conditions
Contract Terms and Conditions: The Subscriber accepts the Terms and Conditions set forth in this document. The Contract Terms and Conditions can always be found and viewed on the Islandcom website. These terms and conditions may be changed from time-to-time. Islandcom will post the most current version of these terms and conditions on the Islandcom website (www.islandcom.tc) or other appropriate location. Please check these regularly to inform yourself about changes to the terms and conditions, policies, news, etc.
Applications for services require credit approval before Islandcom will activate service. If a credit check does not provide results that meet Islandcom’s credit criteria, Islandcom reserves the right to reject the application. In addition, Islandcom requires a deposit for service activation that will be refunded to the customer at the end of service, if there is a balance remaining. Providing a deposit does not relieve the customer of their responsibility to pay all dues at the end of the service period. Subscriber must live within Islandcom’s owned network coverage area.
Cancellations/Early Termination Fee: An Early Termination Fee of the value of the monthly charges for the remaining duration of the contract will be assessed in the event that you terminate your Mobile Service Agreement before the expiration of its term. To complete an early termination request, customer must, (1) pay all charges due, (2) pay the one-time lump sum of the monthly charges for the remaining duration of the contract.
Charges and Payment: You will be charged monthly on your Islandcom wireless bill for all transactions during the previous billing period. If you do not receive a billing statement within fourteen (14) days after the end of the billing period, you should request a replacement from Customer Service Representative. Not receiving an invoice does not remove your obligation to make a payment prior to the due date.
Pricing/Taxes: Prices are subject to change. Prices do not include taxes.
Per Second Increment Billing and Usage: Airtime and other measured usage for calls to TCI numbers are billed in one-second increments, and actual airtime and usage are rounded up to the next full increment at the end of each call for billing purposes. Islandcom charges a full-second increment of usage for every fraction of the last second used on each wireless call. You may obtain usage information by calling customer service or using one of our automated systems. Complaints: You can submit complaints at Islandcom customer service offices verbally or in writing - addressed to Islandcom Customer Service. Islandcom shall investigate all complaints. The complaints are investigated with a deadline of 30 days except for complaints relating to billing, which shall be investigated within 45 days after the receipt of the complaint by Islandcom. Islandcom will inform the subscriber about the result of the investigation, or in case the investigation cannot be completed in 30 days, or in 45 days in case of a billing complaint, Islandcom will inform the subscriber about the reason for the delay and the expected time of the completion of the investigation within 30 days.
Data Services: The Islandcom Wireless Data service also allows postpaid Islandcom users to access the Internet using a data enabled device. Data services include, but are not limited to, features that may be used with Internet and wireless content. The service is provided with a maximum monthly data traffic usage based on the plan selected at the time of service activation. Data traffic usage means the sum of the sent and received data. If you reach the data usage limit before the end of the billing period, the service will be charged based on the rate specified in the chosen data plan. The rates are also clearly stated in this contract, and on the website. These services may be subject to credit approval and may only be available with certain rate plans.
Usage/Billing: Usage and monthly fees will be charged as specified in your plan. Data usage is billed in full-kilobyte increments, and actual usage is rounded up to the next full-kilobyte increment at the end of each data session for billing purposes. Overage is billed by the kilobyte. Network overhead, software update requests, and resend requests caused by network errors can increase measured kilobytes. Airtime and other measured usage are billed in full-second increments for domestic calls and rounded up to the next full-second increment at the end of each call for billing purposes. Airtime rounding may vary from destination to destination and is subject to change. Some services may require an additional monthly subscription fee and/or be subject to additional charges and restrictions. See applicable service materials for complete pricing and terms. Prices do not include taxes, directory assistance, roaming, universal services fees or other exactions and are subject to change. You may obtain usage information by calling customer service or using one of our automated systems.
Roaming: Roaming charges for data or voice service will be charged when outside the Islandcom network. The display on your device will not necessarily indicate whether you will incur roaming charges. Services originated or received while outside the Turks and Caicos are subject to roaming charges. Use of services when roaming is dependent upon roaming carrier’s support of applicable network technology and functionality. Check with roaming carriers individually for support and coverage details. Billing for international roaming usage may be delayed up to three billing cycles due to reporting delays between carriers. See www.islandcom.tc or dial 431-0000 for more information and for a list of currently available countries and carriers. Compatible international-capable handsets required for some markets. Availability, quality of coverage and services while roaming are not guaranteed. Certain tenure, billing and credit restrictions and additional charges may apply.
Information/Content: Certain information or content is provided by independently owned and operated content providers or service providers and may change at any time without notice. Islandcom is not a publisher of third-party information or content and is not responsible for any opinions, advice, statements, or other information, services or goods provided by third parties. Third-party content or service providers may impose additional charges. Policies regarding intellectual property, privacy and other policies may differ among content or service providers and you are bound by such policies when you visit their respective sites or use their services. It is your responsibility to read the rules or service agreements of each content provider or service provider. Any information you involuntarily or voluntarily provide third parties is governed by their policies. The accuracy, appropriateness, content, completeness, timeliness, usefulness, security, safety, merchantability, fitness for a particular purpose, transmission or correct sequencing of any information or downloaded data is not guaranteed or warranted by Islandcom or any content providers or other third party. Delays or omissions may occur. Islandcom will not be liable to you for any loss or injury arising out of or caused, in whole or in part, by any information acquired through the Islandcom network. You acknowledge that every business or personal decision, to some degree, represents an assumption of risk, and that Islandcom, in providing access to information, cannot underwrite, or assume your risk in any manner whatsoever.
Access Requirements: Additional hardware, software, subscription, credit or debit card, Internet access from your compatible PC and/or special network connection may be required and you are solely responsible for arranging for or obtaining all such requirements. Some solutions may require third party products and/or services, which are subject to any applicable third party terms and conditions and may require separate purchase from and/or agreement with the third party provider. Islandcom is not responsible for any consequential damages caused in any way by the preceding hardware, software or other items/requirements for which you are responsible.
Service Availability and Access/Coverage: Islandcom does not guarantee availability of its network. Services may be subject to certain equipment and compatibility/limitations including memory, storage, network availability, coverage, accessibility and data conversion limitations. Services (including without limitation, eligibility requirements, plans, pricing, features and/or service areas) are subject to change without notice. When outside the coverage area, access will be limited to information and applications previously downloaded to or resident on your device. See coverage map(s), available at store locations or at www.islandcom.tc, for details. Actual data download speeds depend upon device characteristics, network, network availability and coverage levels, tasks, file characteristics, applications and other factors. Performance may be impacted by transmission limitations, terrain, in-building/in-vehicle use and capacity constraints.
Security: Islandcom does not guarantee security. Data encryption is available with some, but not all, services sold by Islandcom. If you use your device to access company email or information, it is your responsibility to ensure your use complies with your company’s internal IT and security procedures. Islandcom is not responsible for loss or disclosure of any sensitive information you transmit. Islandcom’s services are not equivalent to landline Internet or phone services. Islandcom is not responsible for nonproprietary services or their effects on devices. Islandcom reserves the right to terminate your services with or without cause, including without limitation, upon expiration or Termination of your mobile service agreement. Your wireless number may be transmitted to Internet sites you visit. You may receive unsolicited messages from third parties as a result of visiting Internet sites.
SMS Text, Instant Messaging and Picture/Video Messaging: SMS Text Messages are limited to 160 characters per message. Premium text and picture/video messages are charged at their stated rates. Different per message charges apply to international messages sent from Turks and Caicos. Text, Instant, Picture, and Video messages are charged when sent whether read or unread by the recipient. Islandcom does not guarantee delivery of messages. Text, Instant, Picture, and Video messages, including downloaded content, not delivered within 7 days will be deleted. Islandcom reserves the right to change this delivery period without notification. You are charged for each part of messages that are sent by you in multiple parts. Picture/Video Messaging, data plan, and Text Messaging may need to be provisioned on an account in order to use. Some elements of Picture/Video messages may not be available to the recipient due to limitations on certain wireless phones, PCs, or e-mail. When a single message is sent to multiple recipients, the sender is charged for one message for each recipient.
Intellectual Property: All trademarks, service marks and trade names used on or in connection with Islandcom services are the property of their respective owners. You must respect the intellectual property rights of Islandcom and any owner of intellectual property whose protected property may appear on any website controlled by Islandcom or accessed through the Islandcom services. Except for material in the public domain, all material displayed in association with Islandcom service is copyrighted or trademarked. Except for personal, non-commercial use, trademarked and copyrighted material may not be copied, downloaded, redistributed or otherwise exploited, in whole or in part, without the permission of the owner. The GSM lettermark is a trademark of the GSM Association.
Additional Terms And Conditions: International Roaming: Available countries, coverage and participating international carriers may vary. See www.islandcom.tc for a current list of participating carriers and available roaming countries.
Postpaid International Dialing: Postpaid plan international dialing rates as per postpaid international rates sheet. Rates may vary.
Postpaid “Free Minutes” include: Local landline calls, Islandcom on-network mobile-to-mobile, Local Mobile calls to other networks and international calls to all world destinations with the exception of destinations listed in the Exceptions List (available in your Islandcom store or on www.islandcom.tc). When Postpaid “Plan Minutes” have been used, additional minutes are charged as per specific rate plan and postpaid international rates sheet.
Included SMS Messages: Free SMS text messages include text sent to any destination (local and international).
Data Pay-Per-Use: Postpaid subscribers without a data plan will be charged on a pay-per-use basis of $0.002/Kb. Rates may vary.
Data Plans: Postpaid subscribers with a data plan will be charged on a pay-per-use basis per/Kb once the data usage provided in plan is exceeded. Rates may vary.
Mobile Email: Requires your own e-mail account with compatible internet service provider and a downloaded or preloaded e-mail application for the wireless device. Access and use of Mobile Email is billed by total volume of data sent and received (in kilobytes) in accordance with your rate plan.
Use of Service: Islandcom services are made available to the customer provided (1) they are not used for anything unlawful, (2) they are not used to create a nuisance or messages of an offensive nature, (3) the customer complies with all laws of the Turks and Caicos Islands, (4) they are not used to send, receive, upload, download or otherwise facilitate any material which is of a menacing nature, a nuisance, a breach of privacy or unlawful, (5) they are not used to access or use content that infringes the rights of others, (6) the SIM Card and mobile telephone numbers allocated to the customer will at all times remain the property of Islandcom and must be returned to Islandcom upon request, (7) handsets subsidized by Islandcom remain bound by the SIM Lock conditions for the duration of the contract period, (8) customers attempting to unlock their phone may cause technical issues with their handset or service for which Islandcom will accept no responsibility, (8) customers agree to cooperate with Islandcom in reasonable security checks when requested.
Exclusion of Liability: Islandcom will not be liable to the customer if unable to provide the Service because of something beyond Islandcom’s control including, but not limited to the following: (1) acts of God, (2) war, (3) hostilities, (4) civil disobedience, (5) acts of terrorism, (6) weather, (7) fire, (8) power failure, (9) failure of interconnected networks, (10) failure of machinery, equipment, (11) malicious acts of vandalism, or (12) strikes or industrial unrest. The customer also agrees to indemnify Islandcom, its dealers, staff, and directors against liabilities, damages, loss, suits and any expenses as a result of loss of service, or the enforcement of these Terms and Conditions. This Exclusion of Liability will continue to apply beyond the contract period.
Law: The law of Turks and Caicos Islands applies to these Terms and Conditions. Any dispute that arises that cannot be settled amicably will be settled in the courts of law of the Turks and Caicos Islands, BWI.
